In the Name of God Amen the ninth day of September Anno domini one Thousand Six hundred and Sixty five and in the seventh month year of the Reign of our Sovereign Lord Charles the second by the grace of God King of England and Scotland France and Ireland Defender of the Faith etc. I Christopher Rigbye of the parish of St Mary Abchurch Cittizen and Merchant Taylor of London being at this present in good health of body and of good and perfect mind and memory thanks be therefore given to Almighty God doe make and declare this my last will and Testament in manner and form following that is to say Imprimis I commend my soul into the hands of Almighty God my Heavenly Father trusting and confidently believing by the death passion merits resurrection and Ascension of his dear son and my alone and all sufficient saviour and redeemer Jesus Christ to be Saved and to have full and Free remission and forgiveness of all my sins iniquityes and by no other wayes or means whatsoever And my body I comitt to the earth from whence it came to be interred and buried in the parish Church of St Mary Abchurch where I now dwell as near to my children that lie there buried as may be if conveniently it may be done or in the parish church of trinity parish near Old Fish Street or otherwise where my Executors and overseers shall think most convenient in such decent and seemly manner and forme as to them shall be thought good Item I give and bequeath unto sarah my wellbeloved Wife which is her due dureing her naturall life one third part of all my lands and Tenements situate and being in the parish of Cosgrave furtho and Potterspery in the County of Northampton in the several tennres or occupation of my brother Henry Rigby And Thomas Chandler or their Assigns or the full third part of the revenue thereof out of the rent of the Lands now in the occupation of the said Thomas Chandler or his Assigns Item I give and bequeath unto my daughter Elizabeth Rigbye during her naturall life one Annuity or yearly rent of ten pounds of lawful money of England to be issuing and payable out of the said Lands and Tento above mentioned now in the occupation of the said Thomas Chandler at two feasts or termes in the year that is to say at the Feasts of St Michael the Archangel and the annunciation of Our Lady St Mary the Virgin or within thirty days next ensuing either of the same Feasts dayes by even and equal portions the first payment thereof to be made on such of the same Feast dayes as shall next happen after my decease or within thirty dayes then next following Item I give and bequeath unto that child or children whether male or female wherewith my wife goeth and is with child of during his her and their natural lives the life annuity or yearly rent of ten pounds a year a piece of like money to be issuing and payable out of the same lands and tenements now in the occupation of the said Thomas Chandler or out of the rent and revenues thereof at the same two Feasts or termes in the year above mentioned or within thirty dayes next ensuing either of the said Feasts by even and equal portions the first payment thereof to be made on such of the same Feast dayes as shall happen after my decease Item I give devise and bequeath unto my son Christopher Rigbye for and dureing the terme of his naturall life (allowing unto his mother thereout in land or money her full third part of all my lands and tenements and paying his said sister Elizabeth Rigbye and his brothers and sisters that his mother now goeth with all their Annuities of ten pounds a year apiece in such manner and forme as above is mentioned) All and singular those Lands and tenements with the appurtenances above mentioned now in the tenure or occupation of the said Thomas Chandler or his Assigns which I purchased of and from Gervase Andrews Esq situate and being in the said parishes of Cosgrave Furtho and Pottersperry in the County of Northampton and after the decease of my said son Christopher Rigby then I give devise and bequeath the same Lands and tenements with thappurtenances unto the heirs of the body of my said son Christopher Rigbye lawfully to be begotten and for want of such issue to the child than my wife goeth with all if a son for and during his natural life and after his decease to the use of the heirs of his body lawfully to be begotten and for want of such issue to the use of my daughter Elizabeth Rigby and the child or children that shall go with the blessing of God born of the body of my said Wife being a daughter or daughters wherewith she now goeth jointly dureing their naturall lives and the survivor or survivors of them and after their decease to the use of the heirs of their severall bodyes lawfully to be begotten And for default of such issue to the use and behoof of my three brothers and my sister Henry Rigbye Gabriell Rigbye John Rigbye and Anne Tyte wife of Henry Tyte for and dureing the Termes of their naturall lives And after their deceases or the decease of any of them to and for the use and behoof of their heirs male of their four severall bodyes lawfully begotten or to be begotten part and portion like and for default of such issue to the use of the right heirs of me the said Christopher Rigby for ever Item I give and bequeath unto the Child wherewith my Wife goeth being a son for and dureing the terme of his naturall life All that piece or parcel of Land now in the tenure or occupation of my said Brother Henry Rigby which I purchased of Mr John Hull being a hook of meadow lyeing at the upper end of Steaning meadow in the above said parish of Furtho in the said County of Northampton And after his decease to the use of the heirs of his body lawfully to be begotten and for want of such issue to the use of my said daughter Elizabeth Rigby and of such child or children as my wife now goeth withall if a daughter or daughters for and dureing their naturall life or lives and after their deceases to the use of the heirs of their severall bodyes and of the body of the survivour or survivors of them and for want of such issue to the use of my son Christopher Rigbye for and dureing the term of his naturall life and after his decease to the use and behoof of the heires of his body lawfully to be begotten and for want of such issue to the use of the right heires of me the said Christopher Rigby for ever and as concerning the disposition of all and singular my personall Estate wherewith it hath pleased Almighty God to endow me I do divide the same into three equal parts and portions according to the lawdable custome of the Citty of London one third part whereof I give and bequeath unto Sarah my welbeloved Wife being her customary part one other third part thereof I give and bequeath unto and amongst my Children being their customary part and the other third part I reserve for my self to pay such legacyes and bequests as I shall give and bequeath to any person or persons whatsoever Imprimis I give and bequeath unto the said Sarah my welbeloved Wife out of my own third part the sume of one hundred pounds of lawful money of England Item I give and bequeath out of my said third part unto my Son Christopher Rigby the sume of one hundred pounds of like lawful money Item I give and bequeath unto my daughter Elizabeth Rigbye out of my said third part the like sume of one hundred pounds of like money Item I give and bequeath unto that child that my wife now goeth Withall the like sume of one hundred pounds of lawful money of England but if my wife shall have more than one Child it is my meaning that the said one hundred pounds shall be equally divided between them part and part alike Item I doe remitt and forgive unto my brother Henry Rigby all my rent due unto me by him for the hook of meadow in Steaning meadow aforesaid together with all debts due to me by him by bill bond accounts or otherwise howsoever over and above the sume of one hundred and Twenty pounds of lawful money of England which I desire him to pay unto my Executors hereunder named within one year next after my decease Item I do also remitt and forgive unto my brother Gabriell Rigby the sum of Twenty pounds which he now oweth unto me And I doe give and bequeath unto my said Brother Gabriell Rigby the sume of twenty pounds more of lawful money of England Item I give and bequeath unto my brother John Rigbye the sume of thirty pounds of lawful money of England and my livery Gown and hood Item I give and bequeath unto my said three Brothers Henry Rigbye, Gabriell Rigbye and John Rigbye all other my wearing apparell whatsoever equally to be divided between them Item I give and bequeath unto my loving Brother Henry Tyte and to my loving sister Anne Tyte his Wife the sume of twenty pounds of lawful money of England to be equally divided between them and to their children Henry Tyte George Tyte Hester Tyte now the Wife of Francis Emerson the younger Anne Tyte and Mary Tyte five pounds apiece of lawful English money of England Item my will and meaning that my cousin Henry Tyte my said sisters eldest son shall have the loane of one hundred pounds of lawful money of England for five years gratis giving security to my executors for their liking to pay it unto them at the five years end Item I give and bequeath unto my daughter Elizabeth Rigbye and to that child or children wherewith my said Wife is now goeth and to the survivor or survivors of them my adventures in the East India Company and all the proffitt thereof together with my interest in the good ship called St George now bound for the East Indies Item I give and bequeath unto my cousin Francis Emerson the elder of Trinity Lane and to my cousin his wife the sume of four pounds to buy them a paire of plates and to my cousin Francis Emerson the younger their sonn the sume of twenty shillings to buy him a ring Item doe remitt and forgive unto Mr Robert Standard all interest due unto me upon his Bond And I give unto him and his wife five pounds to be paid unto them upon the clearing of the account with my Executors to buy them a pair of plates Item I do give and bequeath unto the poor of that parish where I shall be buried the sume of five pounds of lawful money of England Item I give and bequeath unto my Father and mother in law Mr Peter Leaster and Elizabeth his Wife and to my brother Thomas Birkett And my Sister Elizabeth Birkett To my loving Cousin Mr Thomas Tyte and his Wife And to Cousin Charles Gore and his Wife Twenty shillings apiece to buy each of them a ring Item I give and bequeath unto my Sister Havering twenty shillings to buy her a ring and ten shillings apiece to each of her Children And I remitt unto her all the money which she oweth me in the debt Booke Item I give and bequeath unto my brother John Hubbuck ten shillings to buy him a ring and to each of his children five shillings And to my sister Janaway? ten shillings to buy her a ring Item I give and bequeath unto my Cousin Elizabeth Brown daughter of Mr George Brown of Helindon the sum of Tenn pounds and to her Brother Mr John Browne twenty shillings to buy him a ring Item I give and bequeath unto Mr John Gerey Mr Thomas Farmer Mr John Hill Mr John Bryan Mr Richard Billinge Mr Thomas Simpson ten shillings apiece to buy them a ring Item I give and bequeath unto my servants Phillip Nicholls Richard Chowne and Anne Ellis five pounds apiece Item I give and bequeath to the poor of the parish of Cosgrave above mentioned where I was borne the sume of five pounds of Lawful money of England Item I give and bequeath unto the poor of the parish of Stony Stratford in the County of Buck the sume of Fifty shillings Item give and bequeath to the poor of the parish of St Olaves in Southwark the sum of Fifty shillings of lawful money of England Item I give and bequeath to my Cousin Watts of Bromley and his Wife ten shillings apiece to buy each of them a ring and to each of their Children five shillings Item I give and bequeath to my cousin Batchellor of Becknam and to his Wife ten shillings apiece to buy each of them a ring Item I give and bequeath to my loving Friend Lieutenant Colonel Thomas Cox my Cousin Daniell Hart Mr Josiah Griffith Mr Thomas Wymberly Twenty shillings apiece to buy each of them a ring Item I give and bequeath the five pounds which I paid the Company of Merchant Taylors for corne money which is to be returned to me again unto and amongst five Ministers namely Mr John Gardiner Mr Hollinsworth Mr Haviland Mr Bragg and Mr Vening Item I doe nominate and appoint Sarah my welbeloved Wife my loving Cousin Thomas Tyte and my loving Brother John Rigbye joint Executors of this my last Will and Testament desiring as my trust is in them to be careful in the due performance thereof unto whom for their paines to be taken therein I give and bequeath the severall legacies hereafter mentioned that is to say to my Wife twenty pounds in gold to my Cousin Tyte and my Brother Rigbye twenty pounds apiece to buy each of them a gelding makeing my three Executors Guardians unto my Children during their minorities and willing them to dispose of my Childrens Legacye money in land or otherwise for their best advantages and not to pay it or secure it in the Chamber of London or otherwise I declare their Legacyes to be void Frustrate and of none effect Item I do nominate and appoint and I do desire Mr Francis Emmerson the older my brother Henry Rigby my brother Gabriell Rigbye and my brother Henry Tyte to be the overseers of this my last Will and Testament Item I doe give and bequeath all the rest and residue of my said goods chattels plate Jewells Leases household stuff and all other things whatsoever unbequeathed (after my debts legacyes and funerall expences shall be paid and discharged) to be equally divided between my wife and all my children the moiety or one half part thereof to my wife and the other moiety or half part to my Children In Witness whereof I the said Christopher Rigby to this my last will and Testament being contained in eleaven sheets or sides of paper have subscribed my name to every sheet and fixed my seal to the top
