George Griffin 1846

This is the last Will and Testament of me George Griffin of Cosgrove in the County of Northampton Victualler First I will and direct that all my just debts and funeral and testamentary expenses shall be fully paid and satisfied And I nominate and appoint my sister Rebecca Gibbins Widow and my friend Daniel Warren of Cosgrove aforesaid Maltster Executrix and Executor of this my Will I give and bequeath the following pecuniary  legacies that is to say to my dear Daughter Mary the Wife of John Gaskin of Great Linford in the County of Buckingham Stone Mason one hundred pounds to my said Sister Rebecca Gibbins sixty pounds to Joseph Foster of Cosgrove aforesaid Butcher one hundred and fifty pounds to my Brother William Griffin of Wolverton in the said County of Buckingham fifty pounds to Elizabeth the Wife of Richard Hartley of Cosgrove aforesaid Labourer twenty five pounds to John Hartley the Son of the said Richard Hartley and Elizabeth his Wife twenty five pounds and to the said Daniel Warren as a renumeration for the trouble he may have in the execution of the trusts of this my Will ten pounds and I direct that the said several legacies  shall be paid to the several legatees thereof within six calendar months next after my decease and I give and devise all those my messuages or Tenements with the outbuildings yards gardens and appurtenances thereto respectively belonging situate on the West side of Stony Stratford in the County of Buckingham and also all those my messuages or tenements with the outbuildings yards gardens and appurtenances thereto respectively belonging situate at Denshanger in the said County of Northampton and all other my real estate and whatsoever unto and to the use of the said Rebecca Gibbins and Daniel Warren their heirs and assigns for ever upon trust following that is to say upon trust during the natural life of my said Daughter Mary to receive and take the rents of the said devised premises and thereout to keep all the said premises insured from fire and in good repair in all respects and to pay the residue of such rents unto my said Daughter Mary or to such person as she shall by writing under her hand appoint to receive the same notwithstanding her coverture and I declare that the receipt of my said Daughter Mary or her appointee shall alone notwithstanding her coverture be a sufficient discharge to the Trustees or Trustee for the time being of this my Will for such rents or so much thereof as shall in such receipt be expressed to be received to the intent that the same may be for the separate and exclusive use and benefit of my said Daughter Mary during her natural life independently of and not subject to the debts control contracts or engagements of her present or any future husband and shall not in anyway be anticipated by my said Daughter in Mary either alone or jointly with her husband to which end I declare that no direction or disposition by my said Daughter in regard to such rents before the same shall become due shall be binding upon the same or upon my said trustees or trustee and from and immediately after the decease of my said Daughter Mary upon thrust that they the said Rebecca Gibbins and Daniel Warren or the survivor of them his or her heirs or assigns do and shall absolutely sell and dispose of the said premises so devised in trust either together or in lots and either by public Auction or Private contract and subject to such considerations and for such price or prices as my said trustees or trustee shall think proper with full power to buy in all or any part of the said premises at any auction thereof and to rescind any contract for sale thereof and afterwards to sell the same by public auction or private contract without being responsible for any diminution in price on assigned thereon and do and shall covey and assure the said Premises unto the Purchaser or Purchasers thereof as he or they may direct and I direct and declare that every receipt of the Trustees or trustee for the time being of this my Will shall effectually discharge every purchaser or other person paying money under this my Will from the money in such receipt expressed to be received and exonerated every such purchaser or any person and all parties claiming under them respectively from all liability to see to the application or responsibility  on account of such money or any part thereof And I direct and declare that the trustees or trustee for the time being of this my Will shall out of the monies arising from the sale and from the rents and profits until sale of the said Premises so devised in trust pay and discharge all expences attending every such sale and the carrying the same into effect and shall divide the net residue of such monies equally between all and every the children of my said Daughter Mary whether born in my lifetime or after my decease who shall have attained or shall live to attain the age of twenty one years share and share alike to whom I give and bequeath the same accordingly provided always that if at the decease of my said Daughter any one or more of her children shall be under the age of twenty one years it shall be lawful for and I authorise my said trustees or trustee to pay and apply the annual income of the share to which such child shall be presumptively but not actually entitled towards the maintenance education and bringing up of such child during his or her minority All the rest and residue of my monies securities for my money household goods and Furniture and other my Personal estate and effects whatsoever and wheresoever I give and bequeath unto the said Rebecca Gibbins and Daniel Warren upon trust thereout to pay and discharge all my debts and funeral and testamentary expences and the several pecuniary legacies hereinbefore bequeathed and to divide the net residue thereof into three equal parts or shares one of which I give and bequeath unto my said Daughter Mary one other of such parts or shares I give and bequeath unto my said Sister Rebecca Gibbins and the remaining third part or share I give and bequeath unto the said Joseph Foster for their respective absolute use and benefit and I give bequeath and devise all estates which shall at the time of my decease be vested in me upon trust or by way of mortgage whether in fee or for years or any other estate or Interest into and to the use of the said Rebecca Gibbins and Daniel Warren their heirs executors administrators and assigns according to the nature and tenure thereof respectively upon and subject to the trusts and equity of redemption affecting the same respectively and I declare that every trustee of this my Will shall actually receive and shall not be answerable or responsible for any misfortune loss or damage which may happen in the execution of the trusts hereby created unless the same shall happen through his or her wilful neglect or default or for the default of any tenant of the said devised premises in payment of rent or for the insufficiency or deficiency of any security upon which any monies shall at any time be invested and also that every trustee of this my Will shall and may out of the monies which shall come tohis or her hands under this my Will retain to and reimburse himself or herself and allow to each so trustee all costs charges and expences which shall or may be incurred or sustained in the execution of the aforesaid trusts or in relation thereto or to any of them In Testimony whereof I have hereunto set my hand and seal this foweth day of
