Anne Cornelys Indenture 1671

This Indenture make the second day of October Anno Domi: 1671 And in the Three and Twentieth yeare of the raigne of our most gracious soveraigne Lord Charles the second (by the grace of God) of England Scotland France and Ireland King defender of the Faith Betweene Anne Cornelys of St Martins in ye Fields and Countie of Middlesex widdowe and sole Executrix of the last Will and Testament of John Whalley late of Cosgrave in the Countie of Northampton gentleman deceased of the one parte And Francis Emerson and John Clarke present Churchwardens and Richard Rawlins and Richard Pursell present Overseers for the Poore of the parrish of Cosgrave aforesaid of the other parte Whereas the said John Whalley in his life tyme (That is to say) The Twelfth day of January last past before the date of those presents did make his last Will and Testament in writing (amongst other thinges) in these words following (vizt) And whereas my father caused two little Houses to bee erected in the Parrish of Cosgrave and Furtho in the said Countie of Northampton or one of them, for two poore People to dwell in but never settled them, neither have I settled them

All those Two Houses aforesaid with the Appurtenances scituate and being in the said parrish of Furtho or Cosgrave aforesaid or one of them A Close there called Joyners Close towards the west The House of Thomas Ellis (on the Hill) towards the North, The Common streets and well there towards the south and east partes of them: Erected as aforesaid by John Whalley Clarke deceased late father of the said Testator John Whalley To have and to hold the said Two Houses with their and either of them Appurtenances unto the said Francis Emerson John Clarke Richard Rawlins and Richard Purcell and their Successors for the tyme being for ever and hereafter shallbee Churchwardens and Overseers for the Poore of the said parrish of Cosgrove successively Upon speciall trust and Confidence That all the Rents Yssues and Proffitts of the said Two houses and either of them with tier and either of their apprutenances shalbee for ever hereafter from tyme to tyme trulie satisfied and Faithfully paid by the said present Churchwardens and Overseers for the Poore of Cosgrove aforesaid for the Tyme being) for and towards the Succour Helpe and Reliefe of the Poore Peole of the said Parrish of Cosgrove which now and which shallbee for ever hereafter And to and for none other use intent or purpose whatsoever In Wittnes whereof the Parties above named to these present Indentures have Interchangeable putt their hands and Seales

Ann Cornelys Indenture 1686

Indenture made the one and 20th day of December in the second year of the reign of our sovereign lord James the second King of England Scotland France and Ireland King defender of the faith etc. Annoq. Dom 1686--- Ann Cornelys of the parish of Saint Martin’s in the Field in the county of Middlesex widow of the one part William Carpenter--- in the county of Bucks John Nayler Clerke Minister of Cosgrave in the county of Northampton Anthony Trye --- in the County of Northampton and Timothy Freese and John Godfrey of Stony Stratford in the said County of Bucks and--- Witnesseth that the said Ann Cornelys in pursuance of the former intentions to settle the messuage lands tenements--- entones To the uses and upon the Trusts you in after Expressed And according to an Order made in the High---- the Tenth day of July last past before the date hereof and made Between his Majesty’s Attorney General on the---- Stony Stratford and Cosgrave aforesaid plaintiffs and the aforesaid and Ann Cornelys defendant And for and in Consideration-----lawful English money paid by William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey------ Ann Cornelys Receipt whereof Shee doth hereby Acknowledge And for divers other good Causes and Considerations Ann Cornelys hath Granted Aliened Release Ratified and Confirmed And by these presents doth Grants Alien --- to the said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey (in their actual possession now being by virtue of One …..ture of Bargain and Sale for One Year bearing date the day before the day of the date of these presents to them made And of the Stature Eranferrino of Uses into possession All that Messuage or Tenements with the appurtenances in Cosgrave aforesaid late in the Tenure or Occupation of Arthur Whaley or his assigns with a Pightell and Orchards overagainst the same lying in the parish of Forthoe in the said county of Northampton and One Cottage now or late in the Occupation of William Lovell with all the Edifices Buildings Barns Stables Yards Orchards Gardens Backsides Wayes Easements Commodities and Appurtenances whatsoever to the said Messuages Pightell Cottage and premises belonging or in anywise appertaining or therewith uses or any ways Enjoyed And also all her Estate Right Tytle Interest Claim and Demand whatsoever on in and to be Messuages Lands Tenements and a Hereditaments in Cosgrave and Forthoe aforesaid which the said Ann Cornelys formerly Granted in Exchange for the said First mentioned Messuage Cottage Pightell and Orchards with the Appurtenances And Reversion and Reversions Remainder and Remainders of the said premises To have and to hold the aforesaid Messuage or Tenement Pightell Cottage and other premises with the Appurtenances to the said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey their Heirs and Assigns for ever In trust nevertheless and to and for the only benefit of the Poore of the said Towns or Parishes of Stony Stratford and Cosgrave aforesaid in and by the last Will and Testament of John Walley Gentleman deceased Nephew of the said Ann Cornelys mentioned and intended and such as in the said parishes are and shall be Poore as by the said John Whaleys Will were intended for ever And the said Ann Cornelys for herself and her heirs doth Covenant Grant and Agree to and with the said said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey their Heirs and Assigns and Successors and churchwardens of the several towns and parishes aforesaid for the time being That if  the said Messuage and premises or any part thereof shall be Evicted or Recovered by Roger Whalley or his heires or any Claiming or to Claime by From or  under him or them or by any person or persons Claiming any former Right Tytle so that the Exchange formerly made and Executed between the said Ann Cornelys and the said Roger Whaley in part all in the whole continue not That then and from thence for the said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey and successors aforesaid may Enter into and regain them and their Heirs and Assigns for ever All that Messuage or Tenement with the Appurtenances in Cosgrave aforesaid late in the occupation of the said Ann Cornelys and John Clarke And also All that Messuage or Tenement with the Appurtenances now in the Occupation of Robert Johnson and allso that Close of Pasture with the Apputenances in Forthoe aforesaid called Joyner’s Close lying overagainst the said Messuage with all Houses Barnes Stables Malthouses Cisterns Yards Orchards Gardens Backsides Wayes Easements Proffitts and Commodities whatsoever to the Messuage or either of them belonging And that shee the said Ann Cornelys and her Heirs at any time after Recovery or Eviction of the hereby Granted premises or any part thereof shall and will Convey or cause to be Conveyed to the said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey their Heirs and successors aforesaid upon the Trust herein mentioned all whatsoever her or their Right Tytle Estate and Interest in the said last mentioned premises formerly Given and Granted by her the said Ann Cornelys to the said Roger Whalley in Exchange for the herein before first mentioned premises And the said Ann Cornelys for herself her heirs Executors and Administrators and for every of them doth Covernant Promise and Agree to and with the said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey That she the said Ann Cornelys notwithstanding any Act done by her to the contrary is Seized of the said Messuage and premises herein before Granted and Conveyed of an Estate of Inheritance in Free Simple And that free and discharge of an illeg Judgement Charges and Incuberances whatsoever had made or Acknowledged by her the said Ann Cornelys or by any person or persons Claiming illeg by or under her And further that shee the said Ann Cornelys and her heirs shall and will at anytime hereafter make doe and Execute or illeg be made done and Executed All and every such further and other Act and Acts Thing and Things Assurance and Conveyance whatsoever As by the said William Carpenter John Nayler Anthony Trye Timothy Freese and John Godfrey their Heirs and Assigns or by their Counsell learned shall bee from time to time illeg devised or Required for the further and better Assurance of the said before Granted Messuage and premises To the uses and upon the Trust herein before mentioned and declared In witnes whereof the partyes first above named to these presents Interchangable their Hands and Seals illeg day and yeare first above written
