Anthony Chibnall 1830

This is the last Will and Testament of me Anthony Chibnall of Old Stratford in the parish of Cosgrove in the County of Northampton Gentleman being of sound mind memory and understanding First I will order and direct that all my just debts funeral and testamentary expenses be fully paid and satisfied And I give and bequeath unto my dear Wife Mary Chibnall all my household goods and furniture plate linen china wines books liquors that may be in the house at the time of my decease two and for her own use and more for benefit only And I give and bequeath unto William Green of Stony Stratford in the county of Buckingham Butcher and my Nephew Thomas Dickins of No 5 Little East Cheap London Orange Merchant my Executors here in after named the sum of fifteen pounds apiece two and for their own respective use and benefit absolutely for the trouble they may have in the execution of the trusts of this my Will And I also give and bequeath unto the said William Green and Thomas Dickins all my monies securities for money monies in the funds Canal share and all and  And I do hereby further declare that the receipt or receipts of my said Sister Catherine Sirett singular other my personal Estate and Effects whatsoever and wheresoever and of what kind or nature the same may be (not herein before given or bequeathed to my said Wife Mary Chibnall as aforesaid) Upon trust and considering that they the said William Green and Thomas Dickins and the survivor of them his Executors or administrators do and shall soon as conveniently may be after my decease collect and get in my debts and sell dispose of and convert into money such part of my personal Estate as shall not consist of money and my ready money and monies to arise by such sale or sales as aforesaid I direct my said Trustees and the survivor of them his executors administrators after retaining to themselves the sum of fifteen pounds apiece to put and place it out at interest upon such Government or other securities as they or he shall think proper and two and shall to vary alter or transpose such stocks funds or securities for others of the like nature when and as often as it shall seem expedient to them and two and shall stand possessed of and entrusted in the said principal monies stocks funds or securities upon the trusts and to and for their intents and purposes hereafter declared or expressed concerning the same (that is to say) Upon trust that they the said William Green and Thomas Dickins or the survivor of them his executors or administrators do and shall when and as the interest dividends and annual proceeds thereof become due and payable pay and apply the same unto my said Wife Mary Chibnall two and for her own use and benefit absolutely for and during the term of her natural life And from and immediately after the decease of my said Wife I direct my trustees or the survivor of them his executors or administrators to stand possessed of and interested in one fourth part or share of the principal stocks funds or securities in or upon which my personal Estate shall be invested as herein before mentioned upon trust to pay the interest dividends or annual proceeds thereof as and when the same shall become due and payable unto my Sister Catherine Sirett the Wife of John Scrett of stony Stratford aforesaid Grocer two and for her own sole and separate use and benefit for and during the term of her natural life And I do hereby will and direct that the said interest dividends or annual proceeds or any part thereof shall not be subject or liable to be control interference debts or engagements of her present or any future husband but to be absolutely at her own separate and exclusive disposal in the same manner as if she were sole and unmarried And I do hereby further declare that the receipt or receipts of my said Sister Catherine Sirett shall (notwithstanding her own coverture) be a sufficient and full discharge for so much money as in such receipt or receipts shall be acknowledged or expressed to be received And from and immediately after the decease of my said Sister Catherine Sirett I direct my said Trustees and the survivor of them his executors or administrators to pay apply a sign or dispose of the said one forth part or share of the principal stocks funds or securities retained as herein before mentioned for the benefit of my said Sister Catherine Sirett for her life equally between an amongst all and every the children of my said Sister Catherine Sirett but shall be living at the time of her decease share and share alike and the Issue of search of them as shall be dead (such issue nevertheless taking his her or their parents share only) And as to and concerning the other remaining three fourth parts shares only) And as two and concerning the other remaining three fourth parts or shares of the principal stocks funds or securities I direct my said Trustees and the survivor of them his executors or administrators to stand possessed of and interested in the same in manner hereinafter mentioned (that is to say) upon trust immediately after the decease of my said Wife Mary Chibnall to pay and apply a sign or dispose of one other fourth part or share thereof to my Sister Ann the Widow of Charles Dickins deceased two and for her own use and benefit absolutely to whom I give and bequeath the same accordingly And the other remaining fourth part or share thereof unto my brother John Chibnall two and for his own use and benefit absolutely to whom I give and bequeath the same accordingly Provided always and I do hereby declare that in case any or either of them if the said Richard Chibnall Ann Dickins and John Chibnall shall depart this life either in the lifetime of myself or my said Wife Mary Chibnall then that the share of him her or them so dying as aforesaid shall be equally divided between and amongst all and every the children of such Brother or Sister so dying as aforesaid he did equal shares and proportions upon their respectively attaining their ages of twenty one years and the issue of such of them as shall die in the lifetime of my said brothers or Sister such issue nevertheless taking the part or share that his her or their parent would have been entitled to if living And my will further is and I direct that my said Trustees and the survivor of them their and his executors and administrators shall and may retain and reimburse themselves and himself out of any of the said trust monies all such costs charges and expences as they or he shall or may incur sustain or be put unto in the execution of the trusts hereby in them and him reposed And that they my said Trustees shall not be answerable or accountable for the acts and deeds neglects or defaults of each other but each of them for his own acts deeds and neglects and defaults only nor will is or for any more for the said trust monies and than shall come to their hands respectively nor for any loss which may happen to the same unless such a loss shall happen through their own wilful neglect And lastly I do hereby nominate constitute and appoint the said William Green and Thomas Dickins Executors of this my last Will and Testament In witness whereof I the said Anthony Chibnall the testator have to this my last Will and Testament contained in three sheets of paper and to each sheet thereof have set my hand and seal this third day of October in the year of our Lord one thousand eight hundred and twenty eight Anthony Chibnall Signed sealed published and declared by the said testator Anthony Chibnall as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses the words “either myself or” in the last line by one of the second sheet being first interlined

Whereas I Anthony Chibnall of Old Stratford in the Parish of Cosgrove in the County of Northampton Gentleman by my Will bearing date the third day of October one thousand eight hundred and twenty eight have nominated and appointed William Green of Stony Stratford in the County of Buckingham Butcher and my Nephew Thomas Dickins of No 5 Little East Cheap London Orange Merchant Trustees and Executors of this my said Will Mow I do hereby declare it to be my a will and desire that my Nephew Anthony Chibnall of Beachampton  in the County of Buckingham Farmer shall be a Trustee and Executor of my said Will conjointly with the said William Green and Thomas Dickins and accordingly and I do hereby revoke the nomination and appointment of the said William Green and Thomas Dickens as such Trustees and Executors as aforesaid and to nominate and appoint the said William Green Thomas Dickins and my said Nephew Anthony Chibnall joint Trustees and Executors of and for all the trusts and purposes mentioned and expressed in my said Will to each of home I give the sum of fifteen pounds for the trouble they may have in the execution of the trusts of my said Will And I declare this to be a Codicil to my last Will and Testament and desire that the same may be considered and taken as part thereof of In witness whereof I have hereunto set my hand and seal this twenty eighth day of July in the year of our Lord one thousand eight hundred and thirty Anthony Chibnall Signed sealed published and declared by the said Anthony Chibnall the testator as and for a Codicil to his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses thereto E: A: Worley Chas Austin his Clerk
