John Beauchamp 1688

In the name of God Amen.

I John Beauchamp of Cosgrave in the County of Northampton Gent being infirme in Body but of sound mind and memory (Praise be God therefore) nevertheless knowing that nothing is more certaine than death and the illeg thereof uncertaine doe therefore make my last Will and Testament in manner and forme following ( that is to say) First and principally I recommend my soul into the hands of Almighty God my Heavenly Father hoping to be saved by the meritorious death passion Resurrection and Asscension of Jesus Christ my Redeemer and my body I committ to the Earth to be decently interred at the discretion of my Executor hereafter named and as for my worldly Estate I dispose of the same as followeth

Item I give and bequeath unto the poor people of Cosgrave aforesaid the summe of five pounds of lawful money of England to be distributed amongst them on the day of my buryall or the next Sunday after at the discretion of my Executor herein named and alsoe if is my mind true intent and meaning that the said household goods and chattells hereafter mentioned (that is to say) ye best bedstead withall the bedding and furniture thereto belonging one Chest and Cupboard in the Parlour Chamber the best Table in the Parlour one Leaden Cistern one malt mill a dry Fatt and all my hovells Posts and Rafters belonging to the same which are now situate being and belonging unto my now dwelling house and in the yard and malting belonging unto the same shall remaine continue and be standards and belonging unto my now dwelling house Yard and malting aforesaid

Item I give and devise unto my dear and loving wife Sarah Beauchamp twenty bushells of Malt and alsoe my mind and will is that my said Wife Sarah shall or may have liberty to inhabitt and dwell only in the Messuage or Tenement called Gawthornes wherein I now dwell situate and being in Cosgrave aforesaid immediately from and after my decease for and during and untill the full end and Term of one whole yeare from thence next ensuing and fully to be compleat and ended and not otherwise And further my mind and will is that my said Wife Sarah shall during such time of her abode in my said dwelling House according to the true intent and meaning of this my Will have the use only of my Household goods and firewood in the yard and the profitt of the Orchard and Garden there for he own particular necessary use and conveniency during her such abode there as aforesaid Provided alwayes and upon Condition notwithstanding that my said Wife Sarah shall not remove or cause to be removed the said household goods or any part or parcell of the same out of or from my said now dwelling house and from and after the expiration of the said Terme of one year next and immediately after my decease as aforesaid such part of my brass and pewter as came to me by my late Wife Elizabeth I give and bequeath unto my Grandaughter Katherine Gurney to her own absolute use and dispose and all the rest and residue of the same goods not before hereby appointed for Standards as aforesaid I give and bequeath unto my daughters Dorothy Davis and Elizabeth Gurney and my Grandaughters Theodosia Beauchamp Elizabeth Beauchamp and Emma Beauchamp the daughters of my late son John Beauchamp deceased to be equally divided between them in three equal parts

Item I give and bequeath all that Messuage or tenement with the appurtenances wherein I now dwell called Gawthornes in Cosgrave aforesaid together with the Malthouses Barnes Stables Yards Orchards gardens and appurtenenaces unto the same belonging unto my Sonne  in Law William Gurney and Elizabeth his now Wife for and during their naturall lives and the life of the longer liver of them and from and after their decease to my Grandaughter Katherine Gurney for and during the Term of her naturall life and from and after her decease unto the Heirs of her body lawfully to be begotten and for default of such Issue unto my Grandaughter Elizabeth Gurney and the Heirs of her body lawfully to be begotten and for want of such Issue unto the use and behoofe of the right Heirs of my said daughter Elizabeth now wife of the said William Gurney for ever And further my mind and will is that in case my said Wife Sarah doe not claim or demand any Dower or thirds of in or to any part of my reall estate or otherwise doth not disturb my Executor herein named in the Execution of this my Will That then and in such case I do give unto my said Wife all and singular such goods and Chattells as were her own proper goods and chattells before our marriage But in case my said Wife Sarah shall any wise claime or demand her Dower or thirds of in or to any part of my reall Estate or otherwise shall any waies disturb my Executor hereafter named in the execution of this my Will that then in such case immediately after such claime of thirds or Dower by her made or caused to be done or other disturbance by her given as aforesaid I doe give and bequeath all and singular the goods and Chattels whatsoever that were at any time heretofore the goods and Chattells of my said Wife Sarah and whereto or wherein I now have had or might have my Interest or property whatsoever unto my said Sonne in Law William Gurney his Executors Administrators and Assignes

Item I give and devise all those three halfe Acres of Arrable Land I bought of Thomas Nicholls of Castle Thropp in the County of Bucks Yeoman and alsoe those three Acres of Arrable Land purchased of Jarvis [Gervase] Andrews of London and also those four Acres of Land with their appurtenances lying in Ruff Field which were purchased of Robert Emerson formerly called or known by the name of Welles his Land and alsoe All those two Acres more lying in the Moore Feild late Welles his Land And alsoe all those Four Acres of Arrable Land with the appurtenances bought formerly of John Emerson unto my said sonen in Law William Gurney and of Elizabeth his now wife for and during their naturall lives and the life of the longer liver of them and from and after their decease unto my Grandson William Gurney for and during his naturall life and from and after his decease to the Heirs of his body lawfully to be begotten and for want of such Issue unto my said Grandaughter Katherine Gurney for and during the term of her naturall life and from and after her decease then to the Heirs of her body lawfully to be begotten and for want of such Issue unto my Grandaughter Elizabeth Gurney for and during the terme of her naturale life and from and after her decease then to the Heirs of her body lawfully to be begotten and for default of such Issue Then to the use and behoofe of the right Heirs of my said Daughter Elizabeth Gurney the now wife of the said William Gurney for ever

Item I give and bequeath unto my said Daughter Elizabeth Gurney All that Orchard formerly called or known by the name of the old Orchard lying and being in Cosgrave aforesaid adjoining and belonging unto a certain cottage or Tenement in Cosgrave aforesaid now in the occupation of Anne Williams widdow with the appurtenances thereunto belonging To hold to her her Executors Administrators and Assignes from and immediately after my decease for during and untill my Grandson John Beauchamp or the next Heir unto whom the same shall be devised shall attain the Age of one and twenty years

Item I give and bequeath all that Cottage or Tenement with the appurtenances now in the occupation of Anne Williams situate and being in Cosgrave aforesaid together with ye Orchard thereunto adjoining and belonging (from and after the expiration of the said time or terme herein above devised unto Elizabeth Gurney) unto my Grandsonne John Beauchamp eldest sonne of my Grandsonne John Beauchamp deceased for and during the terme of his naturall life and from and after his decease unto the Heirs of his body lawfully to be begotten and for default of such Issue unto my Grandsonne Edward Beauchamp brother of the said John Beauchamp for and during the terme of his naturall life and from and after his decease unto the Heirs of his body lawfully to be begotten and for default of such Issue I give and devise the same unto my Grandsonne William Beauchamp for and during the terme of his naturall life and from and after his decease unto the Heirs of his body lawfully to be begotten and for want of such Issue I give and devise the same unto Theodosia Beauchamp Elizabeth Beauchamp and Emma Beauchamp the daughters of my late son John deceased and their Heirs for ever

Item I give and devise unto my Daughter Mary Horton the now wife of Joseph Horton and late said wife of my late sonen John Beauchamp deceased All that farme with the appurtenances called Flemings Farme late in the occupation of William Battams and late in the occupation of George Stevens together with all Houses Lands Tenements and Hereditaments whatsoever thereunto belonging or therewith now used occupied or enjoyed situate lying and being in Cosgrave Furtho and East Pury in the said County of Northampton or in some or one of them lately purchased by my late brother Edward Beauchamp of my late sonne John Beauchamp deceased and Thomas Scrivener or one of them To hold unto my said Daughter Mary Horton for and during the terme of her naturall life and from and after her decease I give and devise the same unto my said Grandsonne John Beauchamp eldest son of my late sonne John Beauchamp deceased for the terme of his natural life and from and after his decease unto the Heires of his Body lawfully to be begotten and for want of such Issue I give and devise the same unto my said Grandson Edward Beauchamp for and during the terme of his natural life and from and after his decease to the Heirs of his Body lawfully to be begotten and for want of such Issue I give and devise the same Premises unto my Grandsonne William Beauchamp for and during his natural life and from and after his decease unto the Heirs of his body lawfully to be begotten and for want of such Issue I give and devise the same unto Theodosia Beauchamp Elizabeth Beauchamp and Emma Beauchamp the Daughters of my late son John Beauchamp and their Heirs for ever

Item I give and bequeath All that third part of one Wharf or key with the appurtenances lying and being in the parish of St Dunstans East within the City of London called or known by the name or names of Ralphs Key otherwise Cutts Key alias Cookes or Cocks Key together with all and singular the Messuage warehouses and cranes thereupon Erected and built lately purchased by me of Enseby Dormer Gent in the names of Samuell Christie gent and Edward Tompkins in trust for me by Indentures of Lease and Release dated the two and twentieth and three and twentieth days of May in the year of our Lord one thousand six hundred and eighty two and also All that Capital Messuage or Tenement with the appurtenances situate and being in Cosgrave aforesaid and also all that close of pasture ground with the appurtenances in Cosgrave aforesaid And alsoe all that Close of pasture ground with the appurtenances in Cosgrave aforesaid called Brinds alias Brinns conteying by estimation five Acres and alsoe all those arable Lands pastures and meadow ground with their appurtenances conteyning by estimation one hundred and four Acres lying and being in Cosgrave Furtho and East Pury aforesaid some or one of them And alsoe all other the Lands Tenements and Hereditaments which were granted by me and my late sonne John Beauchamp deceased unto my said Brother Edward Beauchamp by Indenture of Feoffment dated the tenth day of June in the year of our Lord God one thousand six hundred eighty one unto my said Grandsonne John Beauchamp for and during the terme of his naturall life subject nevertheless unto the intents purposes provisos uses and limitations hereinafter mentioned and declared (discharged notwithstanding and released of the proviso mentioned in the said Indenture of Feoffment above recited and of and from the sum of six hundred pounds and interest of the same therein mentioned and expressed (that is to say ) To the intent and purpose that my said Grandsonne John Beauchamp shall and may yearly and every year permitt and suffer the said Mary Horton his Mother for and during the terme of her naturall Life to receive and take one Annuity or yearely Rent charge of twelve pounds of lawful money of England out of all and singular the last mentioned premises lying and being in Cosgrave Furtho and East Pury aforesaid to be paid at four dayes or payments in every yeare that to say the five and twentieth day of March the four and twentieth day of June the nine and twentieth day of September the five and twentieth day of December by even and equal portions the first payment thereof to begin and be made on the first of the said dayes which shall happen next after my said Grandsonne John Beauchamp shall attain the Age of one and twenty yeares ana further my mind and will is and to the intent and purpose that the said Grandsonne John Beauchamp shall permitt and suffer his said mother Mary Horton to have hold and enjoy all that the said Messuage Lands pasture ground and premises lying and being in Cosgrave Furtho and Eastpury for and untill my said Grandsonne shall attaine the age of one and twenty yeares for the maintenance and education of all and every of her children by my late son John Beauchamp deceased without rendering any account therefore unto my said Grandsonne John Beauchamp his Heirs or Assigns Provided always that if the said Mary Horton shall at any time or times hereafter claime any estate or interest into or out of the Premises last mentioned in Cosgrave Furtho or Eastpury aforesaid in any waies howsoever that then the said Annuity of twelve pounds per Annum and the further Estate therein lymitted unto her untill my said Grandsonne John Beauchamps Age of one and twenty yeares as aforesaid shall cease determine and be utterly voyd Provided alwayes further that whereas I have by a certaine Indenture of Settlement under my hand and Seal bearing date the twentieth day of this Instant month of January sealed and conveyed all that Wharfe or Key called or known by the name of Ralphs Key above mentioned together with the Warehouses cranes and other buildings thereunto belonging (part whereof is here in above mentioned to be devised unto my Grandsonne John Beauchamp and his Heirs together with the Rents Issues and profitts of the same for and during a certaine terme therein lymitted and appointed unto my Sonne in Law William Gurney his Executors Administrators and Assignes

Now therefore it is my mind true intent and meaning that my said Grandsonne John Beauchamp and his Heires or the next Heire in Tayle unto whom the same Premises may descend by vertue of this my Will shall and do permitt and suffer my said Sonne in Law William Gurney Trustee in the above recited settlement named his Executors Administrators and Assignes To have hold receive and enjoy the said wharf or key and premises and the Rent Issues and proffitts of the same and every part of th for and during all and every such time or terme as is thereby to him and them granted And further my mind and Will is that my said Grandsonne John Beauchamp or his Heirs shall out of his part of the said Wharf or Key above to him or them devised as aforesaid well and truly pay or cause to be paid unto his Sister Emma Beauchamp the summe of two hundred pounds when she shall attain the Age of one and twenty yeares and that from and after the decease of my said Grandsonne John Beauchamp I give and devise all and singular the Premises above mentioned to be devised unto my said Grandsonne John Beauchamp to unto the Heirs of the body of the said John Beauchamp my Grandsonne lawfully to be begotten subject nevertheless unto the Charges provisos bequests and Lymittations above mentioned and for default of such Issue I give and devise the same Premises unto my Grandsonne Edward Beauchamp the second son of my said son John Beauchamp deceased for the terme of his naturall subject nevertheless to the same charges provisos and Lymittations above mentioned and from and after his decease then to the Heirs of the body of my said Grandsonne Edward Beauchamp lawfully to be begotten and for such default of such Issue I give and devise the same Premises unto William Beauchamp another of my Grandsonnes for and during the terme of his naturall life and from and after his decease then unto his Heirs of his body lawfully to be begotten and for want of such Issue I give and devise the same Premises unto Theodosia Beauchamp Elizabeth Beauchamp and Emma Beauchamp the Daughters of my late son John Beauchamp and their Heirs forever

Item I give and devise unto my said Grandsonne John Beauchamp one Close of pasture in Cosgrave aforesaid with the Cottage or Tenement thereupon erected and built now or late in the occupation of widdow Kent which I lately purchased of Richard Rawlins To hold to him and his Heirs for ever

Item I give and bequeath unto my Grandchildren the children of my Daughter Dorothy Davis now the wife of Thomas Davis of Fensham in the County of Bedford Yeoman five hundred pounds apeece for the satisfying and full discharging or all and every of the Legacy and legacies formerly devised unto them in and by the last Will and Testament of my late Brother William Beauchamp deceased bearing the date the one and thirtieth day of January in the yeare of our Lord God one thousand six Hundred sixty and sight to be paid by my Executor herein named when they shall attaine the respective ages of one and twenty years Provided always and upon this condition notwithstanding And my mind and will is that if either or any of the children of my said Daughter Dorothy Davis or any other person or persons for them or any of them shall demand claime or sue for any Estate Legacy matter or thing whatsoever conteyned or mentioned in the will above mentioned of my late Brother William Beauchamp by vertue of the same Will or any matter or thing therein conteyed that then and in such case and from thenceforth the Legacy or Legacyes by me herein devised unto him her or them soe claiming any Legacy or interest by vertue of the Will of my late Brother William Beauchampe as aforesaid  shall not be paid but all and every devise by me unto them herein made shall cease determine and be utterly voyd

Item I bequeath unto my Sonne in Law Thomas Davis the sum of twenty pounds upon Condition nevertheless that my said Sonne in Law do immediately after my decease well and truly pay or cause to be paid unto John Nailer [Naylor] of Cosgrave Clerke his Executors or Administrators the Summe of twenty pounds and interest therefrom due for the payment of which said Summe and Interest I now stand bounded and for the said Thomas Davis unto the said John Nailer [Naylor] and my mind and will is that if the said Thomas Davis shall refuse or neglect to pay the said twenty pounds unto the said John Nailer [Naylor] and thereof to discharge and save harmless my Executors hereafter named That then and in such case the devise of twenty pounds herein to him devised as aforesaid shall be utterly voyd and of none effect and he shall receive no benefitt thereby

Item I give and bequeath unto my said Daughter Dorothy Davis ten pounds to buy her childrens clothes

Item I give and devise unto Mr Lewis Rye of Blakeley in the County of Northampton the summe of ten pounds

Item I give and bequeath unto John Horton of Cosgrave gent the like summe of ten pounds

Item I give and bequeath unto Mr Edward Tompkins the summe of five pounds

Item I give and bequeath unto Mr Peircy Langracke of Stony Stratford Gent forty shillings

Item I give and devise unto my man and maidservants that shall be living with me at the time of my decease twenty five shillings apeece

All the rest of my Lands and Tenements hereditaments and Chattells whatsoever not herein bequeathed I do hereby give and devise unto my said Sonne in Law William Gurney of Cosgrave aforesaid his Heirs Executors and Administrators to his and to their own proper use and behoofe forever and I do constitute and appoint my said Sonne in Law William Gurney Sole Executor of this my last will and Testament and I do hereby Revoake all former Will and Codicils by me any wayes made or declared

In witness whereof I have hereunto sett my hand and Seale this one and thirtieth day of January in the third year of the Reigne of our Soveraigne Lord James the Second King over England etc Annoq Dmd one thousand six hundred and eighty seven
