ABSTRACT OF THE TITLE
Of Mr G F Branson to a Freehold Estate at Cosgrove in the County of Northampton
1861 December 18th By Indenture so dated made between William Franklin of Forest Hill Sydenham in the County of Kent Esq of the first part the said William Franklin and Thomas Franklin of Yardley Gobion in the County of Northants Farmer Devisees in Trust and Executors under the Will of John Franklin late of Towcester in the County of Northants Gentleman deceased of the second part and Henry Pearson Gates of the City of Peterborough Gentleman of the third part
Reciting that by Indenture of Release dated 5th June 1830 duly grounded upon a lease for a year and made between the said John Franklin and Ann Amos widow of the other part in consideration of £1000 to said john Franklin paid by the said Ann Amos the messuages, or premises or tenements and three pieces or parcels of land heredits and premises firstly thereinafter described etc were granted and conveyed unto and to the use of said Ann Amos her heirs and assigns by way of mortgage for securing unto said Ann Amos her executors, admons and assigns the repayment of £1000 and interest at £4.10.0% per annum on 5th December then next which principal sum and moneys were not paid accordingly
AND Reciting that said J Franklin by his will dated 10th December 1850 gave and devised all messuages, cottages, closes, lands, tenements hereditaments and real estate situate and standing lying or being in the several parishes of (amongst others) Cosgrove in the said County of Northants and elsewhere which he might die seised or possessed unto his two sons the said William Franklin and Thomas Franklin on special trusts that said W Franklin and T Franklin or the survivor etc should permit and suffer the Testator’s wife Ann Franklin to receive and take the rents issues and profits of his said several hereditaments and real estate for and during her natural life and after her decease said J Franklin gave and devised all those his several messuages and tenements with the outbuildings yards gardens and appurtenances to the same belonging situate and being in a certain place called The Green in Cosgrove aforesaid and then in the tenure or occupation of Henry Foster and others and also all those several pieces or parcels of enclosed pasture ground called respectively The Green, Little Stocking and Lords Close and containing together 19 acres or thereabouts also situate at Cosgrove aforesaid and then also in the occupation of said Henry Foster and others and also those two small pieces of land containing together about 1 ½ acres which he purchased of John Christopher Mansel Esq likewise situate at Cosgrove aforesaid and then also in the occupation of said Henry Foster and others with appurtenances thereunto respectively belonging to said W Franklin and T Franklin their heirs and assigns upon trust that said W Franklin and T Franklin or the survivor etc should as soon as conveniently might be after the decease of his said wife absolutely sell and dispose of said hereditaments and real estate last mentioned either by public auction or private contract for the most money and best price or prices that could or might be reasonably procured for the same and said J Franklin did thereby declare that the receipt or receipts of he said Trustees given to the Purchaser or Purchasers of his said hereditaments or real estate so by his said Will directed to be sold as aforesaid or any part thereof respectively paying the same should not be obliged to see to the application thereof not be answerable or accountable for the mis-application or non-application thereof nor of any part of the same respectively and by and out of the moys to arise by such sale of the said hereditaments and real estate so directed to be sold as aforesaid should in the first place pay and discharge the costs charges and expenses attending such sale or sales and in making out and deducing a title thereto and in the next place to pay off and discharge a certain mortgage debt or sum of £1000 then charged thereon and secured by said recited Indentures of Lease and Release and due and payable to said Ann Amos he Executors admons and assigns and after such payment and deductions divide the residue of the moys so to arise as aforesaid as therein particularly mentioned and said J Franklin appointed said W Franklin and T Franklin Executors of his said Will
And Reciting that said J Franklin died on 12th July 1856 without having altered or revoked his said Will which was proved by said W Franklin and T Franklin in the Archdeaconry Court of Northampton on 25th October 1856
And Reciting that said Ann Amos by her Will dated 28th November 1851 appointed her brother George Gurney sole Executor thereof and devised all estates which at her decease might be invested in her upon trust or by way of mortgage unto and to the use of her said brother George Gurney his heirs and assigns for ever upon and subject to the trusts and equities affecting the same respectively
And Reciting that said Ann Amos died on 1st August 1854 without having altered or revoked her said Will and the same was proved in the Prerogative Court of Canterbury on 29th December 1854
And Reciting that said George Gurney by his Will dated 18th September 1854 appointed his sons George William Gurney and Samuel Gurney Executors thereof and devised all estates which should at his decease be vested in him upon trust of by way of mortgage unto and to the use of said George W Gurney and S Gurney their heirs and assigns forever upon and subject to the trusts and equities of redemption affecting the same respectively
And Reciting that said George Gurney died on 7th January 1860 without having altered or revoked his said Will and the same was proved in the Principal Registry of Her Majesty’s Court of Probate on 24th July 1860
And Reciting that by an Indenture dated 14th August 1861 made between said G W Gurney and S Gurney of the one part and said W Franklin of or part after reciting that said G W Gurney and S Gurney having occasion for £1000 W Franklin had agreed to advance the same upon having a transfer or assignment of said mortgage debt and security and that said W Franklin on or about 4th July 1860 paid to said G W Gurney and S Gurney £1000 being the full amount of principal and interest due upon said recited secy but no assignment or transfer of said mortgaged debt and secy had been executed It was witnessed that in consideration of £1000 paid by the said W Franklin to said G W Franklin and S Franklin aforesaid said G W Franklin and S Franklin did grant convey and release unto said W Franklin and his heirs the several messuages or tenements pieces or parcels of land and hereditaments described and comprised in said recited Indentures of release by way of mortgage to said Ann Amos with the appurtenances To hold the same unto and to the use of said W Franklin his heirs and assigns for ever subject nevertheless to such right or equity of redemption as was or might be then subsisting by virtue of the said Indenture of Mortgage and it was further Witnessed that for the consideration aforesaid G W Gurney and S Gurney did assign and transfer unto said Wm Franklin his executors admons and assigns said £1000 secured by said recited Indenture of Mortgage and the interest then due thereon and all benefit and advantages thereof to hold the same unto the said Wm Franklin his executors admons and assigns as his and their own proper goods and chattels for ever
And Reciting that said Ann Franklin departed this life on the 186
And Reciting that said W Franklin and T Franklin had agreed with said H P Gates for the absolute sale to him of said messuages lands hereditaments and premises thereinafter described being the estates devised to them for sale in trust as thereinbefore recited free from encumbrances at £2300
And reciting that £1000 only then remained due to said Wm Franklin by virtue of the lastly thereinbefore recited Indenture and that it had been agreed that the same should be discharged out of said purchase moy
It was Witnessed that in pursuance etc and in consideration of £1000 paid by said H P Gates to said Wm Franklin and T Franklin as devisees in trust as aforesaid said Wm Franklin in respect of the estate and interest so vested in him as Mortgagee as aforesaid did grant bargain sell and convey and said W Franklin and T Franklin in respect of their estate and interest as Devisees in trust as aforesaid did and each of them grant bargain sell release and confirm unto said H P Gates his heirs and assigns
FIRSTLY ALL & SINGULAR the messuages or tenements pieces or parcels of land and hereditaments comprised in said recited Indenture of meetings of 5th June 1830 and theretofore described as all those 6 and formerly 4 several messuages or tenements with the houses outhouses edifices and buildings yards gardens and appurtenances to the same respectively belonging situate at Cosgrove in the said County of Northants in a certain place there called The Green formerly in the occupation of Matthew Kingston, William Branson and Thomas Newman and John Jervis or some of them their or some of their undertenants or assigns and then in the several tenures or occupations of Richard Scrivener, Richard Hounslow Joseph Brightwell and the Churchwardens and Overseers of the Poor of Cosgrove aforesaid and their undertenants
And also all that piece or parcel of land called or known by the name of Little Stockings situate in Cosgrove aforesaid and containing by estimation 6 acres (more or less) formerly in the occupation of said Matthew Kingston his undertenants or assigns afterwards of Richard Scrivener and then of Joseph Forster
And all that piece or parcel of pasture or enclosed ground commonly called Lord’s Close situate lying and being in Cosgrove aforesaid containing by estimation 4 acres (more or less) likewise formerly in the occupation of said M Kingston afterwards of said R Scrivener and then of said Joseph Forster
Secondly all those pieces or parcels of land described in the said recited Will of the said J Franklin deceased as purchased by him of John Christopher Mansel Esq
AND Also all that stone built and slated dwellinghouse and other buildings erected and built by said John Franklin on the lands thereinbefore described or some part thereof
All which said several messuages or tenements lands hereditaments and premises intended to be thereby assured were then known by the several names and containing by admeasurement the several quantities stated in the Schedule thereunder written and the same so far as the same were susceptible of delineation were described in the plan drawn in the margin thereof
Together with all houses &c
And the reversion &c
And all the estate &c
To hold and to the use of the said H P Gates his heirs and assigns for ever

1891 October 30th BY WILL so dated the said H P Gates appointed his wife Eleanor Maria Gates sole Executrix of his said Will and he appointed his nephew John Andrew Percival of Peterborough aforesaid Solicitor and Herbert Percival of the inner Temple Esq Barrister at Law and his cousin Henry William Gates of Peterborough aforesaid Sole Trustees thereof
And the Testator gave certain specific and pecuniary legacies and devised certain real estate not including the property the subject of this Abstract and gave devised and bequeathed
All the Residue and remainder of his real and personal Estates and effects to his Trustees or Trustee
Upon Trust for Sale and conversion into money
And the Testator declared that notwithstanding the trust for sale of his residuary estate thereinbefore contained his Trustees or Trustee might in their or his discretion postpone the sale of his real estates or any part thereof for any period during the life of his said wife and that during the life of his said wife no sale of his real and personal estates or any part thereof should be made without her consent in writing
Duly executed by the Testator in the presence of and attested by two witnesses
1893 May 6th The said Testator died [H P Gates]
1893 July 6th The said Will was proved in the Principal Registry of the Probate Division of the High Court of Justice by the said Executrix
1902 April 30th The said Eleanor M Gates died
On 15th January 1845 Henry Pearson Gates, a Peterborough solicitor, married Eleanor Maria Mansel, daughter of the Rev Henry Longueville Mansel, Rector of Cosgrove and Maria Margaret Moorsom, daughter of Admiral Moorsom, a Trafalgar hero her parents’ monuments are in Cosgrove Church at the altar.
Henry Pearson Gates was born in the Cathedral Close at Peterborough Cathedral and was eventually buried there with Eleanor.
He and Maria were married at Cosgrove Church she would have lived at what is now Medlar House, next door, when she was a girl - her family lived in what was then the Rectory. They held their Cosgrove land until Eleanor died in 1902.
Gates Memorial in Peterborough Cathedral for Henry Pearson Gates JP (1893) and added below his wife Eleanor Maria.
He was first mayor of Peterborough and held several lay positions in Cathedral and Diocese.
1906 May 17th By Indenture so dated made between the said Henry Wm Gates of the one part and the said J A Percival and H Percival of the other part
Reciting Will of said H P Gates and that the unsold portions of the residuary real and personal estates of said Testator and the investments representing such investments portions thereof as had been sold were then held by the said J A Percival and H Percival and H W Gates upon the trusts still affecting the same under said Will
And Reciting that said H W Gates was desirous of being discharged from the trusts of said Will
It was Witnessed that said H W Gates by abstracting Deed declared that he was desirous of being discharged from the trusts of said Will and said J A Percival and H Percival thereby consented to the discharge of said H W Gates from the trusts aforesaid and to the vesting in said J A Percival and H Percival alone of the trust property
And it was also Witnessed that all the parties thereto and each of them did thereby declare that
All the lands and hereditaments and also all chattels and also the right of said J A Percival H Percival and H W Gates to recover all debts and things in action then subject to the trusts of said Will
Should immediately upon the execution of abstracting Indenture by all the parties thereto vest in said John A Percival and H Percival alone as Trustees of said Will and as joint tenants for the purposes and upon the trusts thereof

11th Oct 1902 By Indenture of this date made between the said J A Percival and Herbert Percival (Vendors) of the one part and George Frederick Branson of “The Elms” Cosgrove aforesaid (purchaser) of the other part

It Was Witnessed that in consideration of £1515 to the Vendors paid by the Purchaser the Vendors as Trustees conveyed unto the Purchaser
All the hereditaments and premises specified in the schedule
To Hold the same unto and to the use of the Purchaser in fee simple subject as mentioned in said Schedule

The Schedule
Firstly all that piece of pasture land within the messuage tenement or farmhouse barns stables outhouses belonging thereto called “The Green Farm” situate in Cosgrove in the County of Northants containing by admeasurement 15a 1r 27p or thereabouts and being now in the occupation of Mr George Valentine all which premises are delineated and coloured pink in the map or plan drawn in the margin of abstracting presents
Secondly all that piece of pasture land situate in Cosgrove aforesaid containing by admeasurement 3a 3r 32p or thereabouts and being now in the occupation of the said Mr George Valentine delineated and coloured green on the said map or plan
Thirdly all that piece of land with the three messuages or cottages built thereon situate in Cosgrove aforesaid containing by admeasurement 2r 38p or thereabouts and being in the occupation of Messrs Chapman Beasley and Green respectively delineated and coloured blue on said map or plan
The land lastly described in this Schedule is subject to the part thereof lying between the public road and the eastern boundary of the land coloured yellow on said plan and within the dotted lines also shown on said plan to a right of footway and of cartway where necessary for the owner or owners for the time being of the said land coloured yellow to pass and repass thereto and therefrom from and to the public road

This Indenture made the 6th day of November 1911 made between George Frederick Branson of Chingford Hall High Road Leyton in the County of Essex Gentleman (hereinafter called the Vendor) of the one part and Dora Feil the wife of Joseph Henry Julius Feil of 15 Oakmead Road Balham in the County of London (hereinafter called the Purchaser) of the other part
Witnesseth that in consideration of the sum of One Hundred Pounds paid to the Vendor by the Purchaser the receipt of which sum the Vendor hereby acknowledges the Vendor who is seized in unencumbered fee simple in possession of the hereditaments hereinafter assured hereby as Beneficial Owner conveys unto the Purchaser ALL that piece of land with the three messuages or cottages built thereon situate in Cosgrove in the County of Northampton being in the occupation of Messrs Moore and Valentine which premises by way of identification are shewn on the map or plan drawn on the margin thereof and thereon coloured red
To Hold the same unto and to the use of the Purchaser in fee simple And the Vendor hereby acknowledges the right of the Purchaser to production and delivery of copies of an Indenture dated 11th October 1902 and made between Joh Andrew Percival and Herbert Percival of the one part and the Vendor of the other part being a conveyance to the Vendor of (inter alia) the said hereditaments And it is hereby certified that the transaction hereby effected does not form part of a larger transaction or of a series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration exceeds Five Hundred Pounds

This Indenture made the 19th June 1912 between the within named Dora Feil of the one part and Percy Leslie Valentine of 21 Oxford Square in the County of London of the other part
Whereas the within mentioned purchase money of sum of One Hundred Pounds was provided by the said Percy Leslie Valentine and was the proper money of the said Percy Leslie Valentine as the said Dora Feil doth hereby admit and acknowledge
And Whereas the said Percy Leslie Valentine has requested the said Dora Feil and the said Dora Feil has agreed to convey the within mentioned hereditaments to the said Percy Leslie Valentine as hereinafter mentioned
Now This Indenture Witnesseth that in pursuance of the said agreement and in consideration of the premises the said Dora Feil as Trustee doth hereby convey unto the said Percy Leslie Valentine all the within mentioned hereditaments T Hold the same unto and to the use of the said Percy Leslie Valentine in fee simple and It is hereby certified that the transaction hereby effected does not form part of a larger transaction or of a series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration money exceeds Five Hundred Pounds

This conveyance is made the 14th March 1934 Between the within named Percy Leslie Valentine of 71 Vant Road Tooting in the County of Surrey formerly of 21 oxford Square in the County of London Butler (hereinafter called the Vendor) of the one part and Aubrey Cecil Valentine of The Green Cosgrove in the County of Northampton Gardener (hereinafter called the Purchaser) of the other part
Whereas the Vendor is the Estate Owner in possession free from incumbrances of the freehold property hereinafter conveyed and has agreed to sell the same to the Purchaser for the price of £100 (One Hundred Pounds)
Now this Deed Witnesseth that in pursuance of the said agreement and in consideration of One Hundred Pounds paid by the Purchaser to the Vendor on or before the execution of these Presents (the receipt of which sum the Vendor hereby acknowledges) The Vendor as Beneficial Owner hereby conveys unto the Purchaser All that the within mentioned hereditaments To Hold the same unto the Purchaser in fee simple
And it is hereby certified certified that the transaction hereby effected does not form part of a larger transaction or of a series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration money exceeds Five Hundred Pounds

12th March 1962 Letters of Administration with the Will annexed were this date granted out of the Oxford District Probate Registry to Gordon Henri Valentine Feil of Cherwell The Broad Walk Northwood Middx Insurance Company’s Manager and Richard Joseph Lovell Feil of 37 St Charles Square London W10 University Administration Officer sons of deceased
This Conveyance is made 30th May 1962 Between Gordon Henri Valentine Feil of Cherwell Road The Broadwalk Northwood in the County of Middlesex Insurance Company’s Manager and Richard Joseph Lovell Feil of 37 St Charles Square London W10 University Administration Officer (hereinafter called The Vendors) of the one part and William Castle and Josephine Castle his wife both of 4 Manor Close Cosgrove Wolverton in the County of Buckingham (hereinafter called The Purchasers) of the other part.
Whereas
1) Alice Theodora Feil late of 7 The Green Cosgrove aforesaid (hereinafter called The Testatrix) was at the date of her death next hereinafter recited seized of the property hereinafter described for an estate in fee simple in possession free from incumbrances
2) The Testatrix died on 27th October 1961 and her will dated 14th October 1946 was proved by the Vendors as Administrators with the said Will annexed on 12th March 1962 in the Oxford District Probate Registry
3) The Vendors have not given or made any Assent or Conveyance in respect of a legal estate in or affecting the said property or any part thereof
4) The Vendors have agreed with the Purchasers for the sale to them of the said property free from incumbrances at the price of Five Hundred Pounds
Now This Deed Witnesseth as Follows:
1) In pursuance of the said agreement and in consideration of the sum of Five Hundred Pounds paid by the Purchasers to the Vendors (the receipt whereof the Vendors hereby acknowledge) the Vendors as Personal Representatives of the Testatrix hereby convey unto the Purchasers All That Piece of land with the cottages and outbuildings (formerly three messuages or cottages) built thereon or on part thereof and situate in Cosgrove aforesaid and now known as No 20 The Green Cosgrove aforesaid To Hold the same unto the Purchasers in fee simple
2) The Purchasers shall stand possessed of the premises hereby conveyed Upon Trust to sell the same with power at discretion to postpone any sale and shall stand possessed of the net proceeds of sale (after payment of expenses) and of the net rents and profits until sale (after payment of rates taxes costs of insurance and other outgoings) in trust for the Purchasers as joint tenants beneficially
3) Until the whole of the property hereby conveyed has been sold pursuant to the foregoing trust for sale the Purchasers and other the trustees for sale hereunder shall have the full and unrestricted power of mortgaging the premises or any part thereof for any purpose and in any manner and of leasing or otherwise dealing therewith as an absolute beneficial owner of the premises would have if the premises had been vested in him in fee simple
4) The Vendors hereby acknowledge the right of the Purchasers to production of the documents set out in the Schedule hereto and to delivery of copies thereof
5) It is hereby certified that the transaction hereby effected does not form part of a larger transaction or of a series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration exceeds the sum of Three Thousand Five Hundred Pounds

THIS CONVEYANCE is made 4th June 1971 between William Castle and Josephine Castle his wife both of 20 The Green both formerly of 4 Manor Close Cosgrove Wolverton in the County of Buckingham (hereinafter called The Vendors) of the one part and Nigel Hugh Flack of White Lodge Frogmore Bottom Kings Walden Hitchin in the County of Hertford Commercial Air Pilot (Hereinafter called The Purchaser) of the other part
Whereas
The Vendors are seised of the property hereinafter described for an estate in Fee Simple Absolute in possession free for encumbrances on trust to sell the same and to hold the proceeds of sale thereof as trust for themselves as beneficial joint tenants
Whereas
The Vendors have agreed with the Purchaser for the sale thereof to him at the price of £7250
Now This Deed Witnesseth that in pursuance of the said agreement and in consideration of the sum of Seven Thousand Two Hundred and Fifty Pounds (£7250) paid by the Purchaser to the Vendors (the receipt whereof the Vendors hereby acknowledge) the Vendors as Beneficial Owners Hereby Convey unto the Purchaser all that piece of land with the cottages and outbuildings (formerly three messuages or cottages) built thereon or on part thereof and situate in Cosgrove aforesaid and now known as 20 The Green Cosgrove aforesaid to hold the same unto the purchaser in fee simple

THIS CONVEYANCE is made 2nd August 1974 Between Peter Clarke of Little Orchard Cosgrove in the County of Northampton and Lesley Dorothy Clarke his wife of the same address (hereinafter called The Vendors) of the one part and Nigel Hugh Flack of 20 The Green Cosgrove aforesaid (hereinafter called The Purchaser) of the other part
Whereas
1) The Vendors are seised of the property hereinafter described for an estate in fee simple in possession subject as hereinafter mentioned but otherwise free of incumbrances
2) The Vendors have agreed with the Purchaser for the sale to him of the said property for an estate in fee simple in possession subject as aforesaid but otherwise free from incumbrances at the price of Four Hundred Pounds (£400)
NOW THIS DEED Witnesseth as follows :
1. In pursuance of the said agreement and in consideration of the sum of Four Hundred Pounds now paid by the Purchaser to the Vendors (the receipt whereof the Vendors hereby acknowledge) the Vendors as Beneficial Owners hereby convey unto the Purchaser ALL that piece or parcel of land situate in Cosgrove in the County of Northampton being part of O S 210 and containing 79 square yards or thereabouts and bounded on the north western side thereof by land now belonging to the Purchaser and known as 20 The Green Cosgrove aforesaid and on the south eastern side thereof by land now belonging to the Vendors and known as Little Orchard Cosgrove aforesaid ALL which said property is for the purpose of identification only and not further or otherwise delineated on the plan annexed hereto and thereon coloured pink to Hold unto the Purchaser in fee simple subject to the restrictive covenants contained in a Conveyance dated 14th February 1966 and made between Cosgrove Lodge Ltd of the first part Midland Bank Ltd of the second part and the said Peter Clarke of the third part
2. The Purchaser (with the object of affording to the Vendors full indemnity in respect of any breach of the said restrictive covenants contained in the said conveyance dated 14th February 1966 but not further or otherwise) hereby covenants with the Vendors that the Purchaser and the persons deriving title under him at all times hereafter will perform and observe the said restrictive covenants and will keep the Vendors and their respective estates and effects indemnified against all actions proceedings costs charges claims demands and liabilities in respect thereof so far as the same affect the property hereby conveyed and is still subsisting and capable of taking effect

3. The Purchaser hereby covenants with the Vendors that he will within six months of the date hereof at his own expense and in a proper and workmanlike manner and to the satisfaction in all respects of the Vendor erect and make and forever after maintain and keep in good repair a substantial boundary fence along the entire length of the south eastern side of the said property hereby conveyed
4. The Vendors hereby acknowledge the right of the Purchaser to production of the documents specified in the schedule hereto (the possession of which is retained by the Vendors) and to the delivery of copies thereof and undertake with the Purchaser for the safe custody of the same
5. It is hereby certified that the transaction hereby effected does not form part of a larger transaction or of a series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration exceeds £15,000

THIS CONVEYANCE is made 30th June 1989 between Bruce Thomas West and Maureen West both of Wildwood Cottage The Green Cosgrove in the County of Northampton (hereinafter called The Vendors) of the one part and Stephen Colin Field and June Field both of Hillcrest Cottage Moulsoe Newport Pagnell in the County of Buckingham (hereinafter called The Purchasers) of the other part
Whereas
1. The Vendors are seised of the property hereinafter described for an estate in fee simple in possession subject as hereinafter mentioned but otherwise free from incumbrances
2. The Vendors have agreed with the Purchasers for the sale to them of the said property for an estate in fee simple in possession subject as aforesaid but otherwise free from incumbrances at the price of £245,000 and it has been agreed that the same shall be vested in the Purchasers in manner hereinafter appearing
Now This Deed Witnesseth as follows
1. In pursuance of the said Agreement and in consideration of the sum of £245,000 now paid by the Purchasers to the Vendors (the receipt whereof the Vendors hereby acknowledge) the Vendors as Beneficial Owners hereby convey unto the Purchasers Firstly all that freehold land with a dwellinghouse erected thereon now known as Wildwood Cottage Cosgrove Northamptonshire formerly known as 20 The Green Cosgrove aforesaid and previously forming numbers 20 and 22 The Green Cosgrove aforesaid as indicated on the plan annexed hereto and thereon edged red and Secondly all that parcel of freehold land also situate at Cosgrove aforesaid being part of the enclosure OS 210 and containing seventy nine square yards or thereabouts more particularly referred to in a Conveyance dated 20th August 1981 (hereinafter called the Said Conveyance) and made between
Nigel Hugh Black [Flack] of the one part and the Vendors of the other part and being included in the property edged red on the plan annexed hereto
Together with (so far as the Vendors can grant the same in fee simple) the rights of way to go pass and repass over and along the length of the roadway and footpath upon which the property abuts at all times and for the purposes to and from the public highway
And Together also with such rights under and over the said roadway and footpath and otherwise for all service media for the benefit of the property hereby conveyed as the Vendors have enjoyed in respect of drainage for water and soil and the supply of electricity and telephone communication To Hold the same unto the Purchasers in fee simple as beneficial joint tenants To Hold in respect of the said land herein Second described the covenants contained or referred to in the Deeds stipulated in the second Schedule to the said Conveyance so far as the same relate to the said land hereinbefore Secondly described and are still subsisting and are capable of being enforced
2. The Purchasers hereby agree and declare that the Trustees for the time being of the Deed shall have as full a power to deal with or dispose of all of any part of the said property (whether by sale mortgage charge lease or otherwise) as sole owner
