Eleanor Biggin 1788

This is the last Will and Testament of me Eleanor Biggin of Marylebone High Street near Paddington in the County of Middlesex Widow whereby I do dispose of all my Estate and Effects in the manner and form following that is to say First I direct that all my just debts Funeral and Testamentary  charges and Expences be paid And I give and bequeath to my Son in law Colonel John Mansel the sum of Fifty Pounds for a Ring in remembrance of me Also I give and bequeath to my Grandson John Christopher Mansel an Ensign in the Army Son of the said Colonel Mansel the Sum of two hundred and Fifty pounds towards purchasing him a Lieutenancy but in case my said Grandson  shall have attained that Rank at the time of my decease than I revoke the said Legacy of two hundred and Fifty pounds and I give and bequeath to my Sister Mary Coversale [ spelt Coverdale in John Biggin will] the Sum of Fifty pounds per Annum for and during the term of her natural life upon Condition nevertheless that she my said Sister do and shall well and effectually release and discharge a Legacy of the like annual amount given to her in and by the Will of my late dear Husband charged upon ..rtain shares of the Coal Exchange near Billingsgate London which said shares not being regular in their produce under the Payment of the said Annuity given my said sister by my said late Husband uncertain and therefore I give her the before mentioned Annuity in lou of that given her by my said Husband and I do hereby charge and make liable all my Estate which I hold under Jesus College situate in the parish of St Mary Lambeth  in the County of Surry with the due and pr..ctual Payment of the said Annuity at and by four equal quarterly payments in the year that is to say the twenty fifth day of March the twenty fourth day of June the twenty fourth day of September and the twenty fifth day of December free and clear of and from all manner of deductions whatsoever the first payment of the said annuity to be made on such of said quarterly  days as shall happen next after my decease All the rest residue and remainder of my Estate and Effects whatsoever and wheresoever both real and personal I will and direct shall be divided into two equal parts or shares and one of such two equal parts or shares of such Residue I give devise and bequeath unto my dear son George Biggin his Heirs Executors Administrators and Assigns for ever and for his own use and benefit and the other Moiety or half part thereof I give devise and bequeath unto the said George Biggin and Captain John Boyle of the Royal Navy their Heirs Executors and Administrators upon Trust  nevertheless and to and for the uses  Intents  and Purposes hereinafter mentioned and  declared of and concerning the same that is to say upon Trust that they the said Trustees or the survivor of them his Heirs Executors or Administrators do and shall permit and suffer my daughter Mary Ann the wife of the said Colonel Mansel to have receive and take the Rents Issues and Profits Interest and  Annual  proceeds of the said last mentioned Moiety of such Residue to and for her own use and benefit for and during the term of her natural life and from and after her decease upon Trust to convey assign and assure the said last mentioned Moiety of such Residue unto and amongst all the Children of my said daughter Mary Ann (her eldest son who is already provided for only excepted) equally between or amongst them share and share alike and their respective Heirs Executors and Administrators and Assigns provided always nevertheless that in case the respective Shares of such last mentioned Moiety after the death of my said daughter shall not amount to the Value and Sum of one thousand pounds for each of her children except her oldest son Then it is my Will and Mind that her oldest daughter Mary Ann shall in the first place have and take the full Sum of one thousand Pounds for her slcome?  thereof and that the remainder shall be divided equally between or amongst the rest of the Children of my said Daughter the oldest Son and Daughter excepted and their respective Heirs Executors and Administrators and Assigns and I appoint my said son George Biggin the sole Executor of this my Will hereby revoking and making void all former and other Wills by me at any time heretofore made  In Witness whereof I the said Eleanor Biggin have to this my last Will and Testament contained in two Sheets of Paper put my Hand to the first Sheet and to this second and last sheet thereof my Hand and Seal the ninth day of March in the Year of our Lord One thousand seven hundred and eighty seven E Biggin (L.S.) signed sealed Published and declared by the above named Eleanor Biggin as and for her last Will and Testament in the presence of us who at her request in her sight and in the presence of each other have subscribed our Names as Witnesses to the due Execution of the same Elizabeth Adams No 15 Paddington Street John Sudlow Monument Yard Josh Scott his mark

This Will was proved at London on the seventh day of June in the Year of our Lord One thousand seven hundred and eighty eight before the Worshipful John Nicholl Doctor of Laws Surrogate of the Right Worshipful Peter Calvert Doctor of Laws  Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constitued by the oath of John Biggin Esq [error? Should be George?] the son of the deceased and the Executor named in the said Will to whom Administration  was granted of all and singular the Goods Chattels and Credits of the said deceased he having been first sworn duly to administer
