Indenture made the Twenty sixth day of December in the Tenth year of the Reign of our Soveraign Lord George by the Grace of God of Great Britain France and Ireland King Defender of the Faith etc. Annoq Dim One thousand seven hundred and twenty three Between William Thomson of Hannington in the County of Northampton Clerke of the one part and Thomas Scrivener of Potterspury in the said County of Northampton Yeoman of the other part Witness That for a Consideration of the Rents and Covenants hereinafter mentioned on the part and behalf of the said Thomas Scrivener his Executors Administrators and Assigns to be paid done and performed He the said William Thomson hath Demised Leased sett and to Farm letten and by these Presents doth Demise Lease lett and to Farm let unto the said Thomas Scrivener his Executors Administrators and Assigns All that Messuage Tenement or Inn with the Barns Stables Yards Orchards and Gardens thereunto belonging situate and being in the Parish of Cosgrave in the County of Northampton and commonly called or known by the Name or Sign of the George And All those severall Closes Arable and Pasture ground with their appurtenances to the said Messuage or Inn belonging and to and with the same now or late used occupied or enjoyed All which said Premisses late were in the Tenure or Occupation of Richard Miller (Except and always reserved out of this present demise unto the said William Thomson his Heirs and Assigns All Timber Trees and other Trees Thorns Wood Underwoods Spinneys and Hedges now standing growing or being or which during this present demise shall stand grow or be on the said Premisses or any part thereof Together with free Liberty of Ingress Egress and Regress Way and Passage to and for the said William Thomson his Heirs and Assigns and his and their Servants Agents and Workmen Horses Carts and Carriages to Fell Cutt down and Carry away the same at seasonable times) To have and to hold the said Messuage and Tenement or Inn Closes and Premises with their Appurtenances hereby demised (Except as aforesaid) unto the said Thomas Scrivener His Executors Administrators and Assigns from the Feast day of St Thomas the Apostle last past before the Date hereof for and during and unto the full End and Terme of Six years from thence next ensuing and fully to be complete and ended Yielding and Paying therefore Yearly and every Yeare dureing the said Terme unto the said William Thompson his Heirs and Assigns the Rent or Sume of Twenty eight Pounds of Lawful money of Great Britain by Too halfe yearly equal Payments on the Twenty fourth day of June and the Twenty first day of December in every year the first payment thereof to begin and be made on the Twenty fourth day of June next ensueing the date hereof And alsoe Yeilding and Paying Yearly and every Year during the said Terme unto the said William Thomson his Heirs and Assigns over and above the aforesaid reserved Yearly Rent) the Summe of Five Pounds an acre for every acre of the said demised Premises (Except what is now in Tillage which the said Thomas Scrivener his Executors Administrators or Assigns shall at any time during the said Tenure Plough Digg up or Convert into Tillage and soe proportionably for a greater or lesser quantity to be paid by Too half yearly equal Payments on the days aforesaid the first payment thereof to begin and be made on such of the said days as shall first happen next after such ploughing digging up or converting into Tillage as aforesaid provided always nevertheless that of the said reserved Yearly rents or any other part of them or either of them shall happen to be behind and unpaid by the space of one and twenty days next after either of the said days on which the same shall respectively become due (the same being lawfully demanded Then and from thereforth it shall be lawful to and for the said William Thomson his Heirs or Assigns into and upon the said demised premises or any part thereof in the name of the whole to re-enter and the same to have again repossess and enjoy as in his and their former Estate any thing herein contained to the contrary notwithstanding And the said Thomas Scrivener for himself his Heirs Executors Administrators and Assigns and for every of them doth covenant promise and agree to and with the said William Thomson his Heirs and Assigns by these presents in manner following (that is to say) That he the said Thomas Scrivener his Executors Administrators and Assigns shall and will well and truly pay or cause to be paid unto the said William Thomson his Heirs and Assigns the aforesaid reserved Yearly rents on the several days and times herein before mentioned and appointed for payment thereof according to the true intent and meaning of these presents And shall and will alsoe pay bear disperse and discharge all Church and Parish duties and all Taxes Levies and Assessments whatsoever which now are or which at any time during this present demise shall be Charged Assessed or imposed on the said Premises or any part thereof by Authority of Parliament or otherwise howsoever (Except the Land Tax and Militia only) And also That he the said Thomas Scrivener his Executors Administrators and Assigns shall will during the said Tenure hereby demised uphold maintain and keep the said Messuage Tenement or Inn with the Barns Stables and Outhouses thereunto belonging in good sufficient and Tenantable repair and the same so sufficiently Repaired at the End or other sooner determination of the said Terme shall and will quietly and peaceably leave Surrender and yield up unto the said William Thomson his Heirs or Assigns unless the same be burnt down by Fire or blown down by wind then and in such Case the same shall not be rebuilt by the said Thomas Scrivener his Executors Administrators or Assigns And alsoe That the said Thomas Scrivener his Executors Administrators and Assigns shall and will dureing the said Terme after a good and Husbandly manner lay bestow and expend all the Muck Manure and Compost that shall arise from the Product of the said Premisses in and upon the said Premisses (and not elsewhere) for the manureing and improving thereof Except the Muck Manure and Compost that shall be made of the last Year’s Cropp which is hereby agreed to be left in the Yard or some other convenient part of the said Premisses for the Use of the said William Thomson his Heirs or Assigns he or they paying to the said Thomas Scrivener his Executors Administrators and Assigns soe much money for the same as shall be adjudged reasonable by Two indifferent persons the one to be chosen by the said Thomas Scrivener his Executors Administrators or Assigns the other by the said William Thomson his Heirs or Assigns And further That he the said Thomas Scrivener his Executors Administrators or Assigns shall and will during the said Terme at his and their own Costs and Charges well and sufficiently Repair and Amend all the Mounds Fences Gates and Styles and scoure the Ditches belonging to the said Demised Premisses and also repair amend and scoure the Mounds and Ditches of all the Spinneys lying next to the Highway and Common Fields and att the End of the said Terme shall and will leave the Same in good Repair And Further alsoe That the said Thomas Scrivener his Executors Administrators or Assigns shall not or will att any time dureing the said Term cut lopp or topp any of the Timber Trees or other Tree Thorns Wood or Underwood now growing or which att any time dureing this demise shall grow on the said Demised Premises or any part thereof without the Consent of the said William Thomson his Heirs or Assigns first had and obtained (Except the outside Hedges of the said Closes hereby demised and such part of the Hedges belonging to the Spinneys which lye next the Highway and Common Fields which last mentioned Hedges it is hereby agreed that the said Thomas Scrivener shall have liberty to cutt in a Husbandly manner at seasonable times dureing the said Terme Three feet in Breadth from the ditches And the said William Thomson for himself his Heirs and Assigns doth Covenant Promise and Agree to and with the said Thomas Scrivener his Executors Administrators or Assigns by these Presents in manner following ( that is to say) That he the said William Thomson his Heirs or Assignes shall and will at their own Costs and Charges with all convenient speed cause to be set up such Gates and Styles as are now wanting upon the said Premisses And shall and will alsoe once in every Two years of the said Terme hereby demise permit and suffer the said Thomas Scrivener his Executors Administrators and Assigns to cutt one wagon Load of Thorns or Underwood from off some convenient part of the said Premises to be Assigned and Sett out by the said William Thomson his Heirs or Assigns towards the Repairing and amending the Mounds and Fences belonging to the said demised Premisses And further That the said Thomas Scrivener his Executors Administrators and Assigns shall have the free Use and Liberty the Barns Stables and Yards belonging to the said demised Premises untill the Feast day of the Annunciation of the Blessed Virgin Mary next after the Expiration of the said Terme hereby demised to spend the Hay Straw Stover which shall arise from the last years Product of the said Premises And Lastly That the said Thomas Scrivener his Executors Administrators and Assigns paying the Rents as the same are herein and hereby reserved and observing performing and keeping all and singular the Covenants and Agreements herein before mentioned which on his and their parts and behalfs are to be observed performed fulfilled accomplished paid and kept shall and may peaceably and quietly have hold use occupy possess and enjoy all and singular the said hereby demised Premisses with their Appurtenances (Except before Excepted) for an dureing all the said Terme hereby demised without the lawful dett Suite Trouble Interruption Molestation or Disturbance of the said William Thomson his Heirs or Assigns or of any other person or persons Lawfully Claiming or to Claim by from or under him them any or either of them In Witness whereof the parties first above named to these present Indentures Interchangeably have sett their Hands and Seals the Day and Year first above written
